1.0 MPfm

MPfm is freeware and can be freely distributed, as long as you distribute all the licences included in the original package. You must also reprint all the copyright and trademarks listed in the MPfm license.

MPfm: Music Player for Musicians and the mp4m.org website are Copyright © 2011 Yanick Castonguay, except for the BASS and BASS.NET libraries (see copyright notices below).

MPfm: Music Player for Musicians is free software: you can redistribute it and/or modify it under the terms of the GNU General Public License as published by the Free Software Foundation, either version 3 of the License, or (at your option) any later version.

1.1 BASS/BASS.NET GPLv3 Exception

The "BASS/BASS.NET GPLv3 Exception" section consists of the "1.1.1 Definitions" and "1.1.2 Exception" sections.

1.1.1 Definitions

"MPfm" means the MPfm: Music Player for Musicians software licensed under version 3 of the GNU General Public License (collectively, "GPL"), or a work based on such software and licensed under the GPL.

"BASS" means the BASS multiplatform audio library for Windows, Mac, Linux and other devices. The BASS library is Copyright © 1999-2011 Un4seen Developments. The BASS library is not free nor open-source; however its license enables use of the library for non-commercial usage only if it does not generate money through sales, advertising, etc. For more information about the BASS license, click here.

"BASS.NET" means the .NET framework wrapper for the BASS audio library. The BASS.NET library is Copyright © 2005-2011 radio42. The BASS.NET library is not free nor open-source; however its license enables use of the library for non-commercial usage only if it does not generate money through sales, advertising, etc. For more information about the BASS.NET license, click here.

1.1.2 Exception

You have permission to copy, modify, propagate, and distribute a work formed by combining MPfm with the BASS and BASS.NET audio libraries, or a work derivative of such a combination, even if such copying, modification, propagation, or distribution would otherwise violate the terms of the GPL. You must comply with the GPL in all respects for all of the code used other than the BASS and BASS.NET audio libraries.

You may include this "BASS/BASS.NET GPLv3 Exception" and its grant of permissions when you distribute MPfm. Inclusion of this notice with such a distribution constitutes a grant of such permission. If you do not wish to grant these permissions, remove this section entitled "BASS/BASS.NET GPLv3 Exception" from your distribution.


2.0 Third-party Libraries

MPfm is using the following third-party libraries:

2.1 BASS

BASS is a multiplatform audio library for Windows, Mac, Linux and other devices. The BASS library is Copyright © 1999-2011 Un4seen Developments. The BASS library is not free nor open-source; however its license enables use of the library for non-commercial usage only if it does not generate money through sales, advertising, etc. This distribution of MPfm meets this requirement since it is released under the GPLv3 license and qualifies as free software. However, the use of the BASS library requires an exception to the GPLv3 license, which makes MPfm not fully GNU compliant.

If you wish to use the MPfm source code in commercial projects, you are *REQUIRED* to contact Un4seen Developments and purchase the license that fits your needs.

2.2 BASS.NET

The BASS.NET library is a BASS audio library wrapper for the .NET framework. The BASS.NET library is Copyright © 2005-2011 radio42. The BASS.NET library is not free nor open-source; however its license enables use of the library for non-commercial usage only if it does not generate money through sales, advertising, etc. This distribution of MPfm meets this requirement since it is released under the GPLv3 license and qualifies as free software. However, the use of the BASS.NET library requires an exception to the GPLv3 license, which makes MPfm not fully GNU compliant.

Any project (commercial and non-commercial) using the MPfm source code *REQUIRES* an individual BASS.NET key which can be obtained through this website: http://bass.radio42.com/bass_register.html.

If you wish to use the MPfm source code in commercial projects, you are *REQUIRED* to contact radio42 and purchase the license that fits your needs.

2.3 SQLite

2.5 TagLib#

TagLib# (taglib-sharp) is released under the GNU Lesser General Public License 2.1 (LGPL). The LGPL license can be found here. A copy of this license is distributed with MPfm and can be found in the application directory (LGPL2.1.TXT). For more information about TagLib#, click here.

2.6 FamFamFam Silk Icons

The FamFamFam Silk icons are released under the Creative Commons Attribution 2.5 License. These icons have been created by Mark James. More information about the FamFamFam icon license can be found here.

2.7 Open Source Fonts

MPfm is embedding the following open source fonts in MPfm.Fonts.dll:

Junction is designed by Caroline Hadilaksono. More information about this font can be found here.

League Gothic is designed by The League of Moveable Type. More information about that font can be found here.

TitilliumText is designed by the Accademia di Belle Arti Urbino. More information about this font can be found here.

Droid Sans Mono is designed by Steve Matteson of the Ascender Corporation. More information about this font can be found here.

The Junction, League Gothic and TitilliumText fonts are released under the SIL Open Font License 1.1. A copy of this license is distributed with MPfm and can be found in the application directory (SIL_OPEN_FONT_LICENSE_1.1.TXT).

The Droid Sans Mono font is released under the Apache License 2.0. A copy of this license is distributed with MPfm and can be found in the application directory (APACHE_LICENSE_2.0.TXT).


3.0 Other License Information

Here is more important information about the MPfm license:

3.1 MP3

Officially, all applications decoding MP3 files must pay a license to the MP3 copyright owner, Technicolor. However, this distribution of MPfm is released under the GPLv3 license and is available free of charge. The MPfm source code is available for anyone to download on SourceForge.Net. This means its copyright owner is not making money with this product.

Microsoft Windows also comes with a built-in MP3 decoder, and Microsoft is paying the license for all Windows copies. Thus, Technicolor does not enforce the patent for Windows freeware MP3 decoders such as MPfm (and other freeware players such as Foobar2k).

A declaration from Thomson (older name for Technicolor) says that they will not charge a per unit royalty on freely distributed MP3 decoders. This declaration can be found here.

However, if you wish to release a commercial product using the MPfm source code, you are *REQUIRED* to contact Technicolor to pay the due royalties. The MPfm copyright owner is *NOT RESPONSIBLE* for any royalties involving audio file formats for commercial use of this source code.
